What is a Copyright?

A copyright is an intellectual property right that protects original works or authorship and gives the owner the right to reproduce, publish, sell, lease, and distribute copies of their work. Markery Law counsels clients in all aspects of copyright protection and enforcement and provides assistance with registering copyrights, licensing, cease and desist letters, and takedown notices under the Digital Millennium Copyright Act (DMCA).

  • License – A copyright owner may wish to license its copywrited work to a third party. We can help you drafting and reviewing licenses for original works of authorship.
  • Assignment – A copyright owner may wish to assign the ownership of its work to a third party. We can help you drafting and reviewing copyright assignments for original works of authorship.
  • Filing – Copyrights are established automatically once fixed in a tangible form, but additional rights are provided upon registration. We help clients register their work with the Copyright office.
  • Notice & Takedown – With the massive volume of content being created and used on the internet, there are also issues with infringement of copyrights by third parties. We have experience assisting clients with protecting and enforcing their copyrights.

Domain name

  • A domain name consists of words and/or numbers (i.e., the information to the left of the dot) and the generic top-level domain (“gTLD”) (i.e., the information to the right of the dot). The purpose of a domain name is to direct consumers to a company’s information on the Internet. The most common gTLDs are .com, .net, and .org, but they can also be country codes like .us or a variety of new gTLDs.
  • Domain Name Services
    • Assignment – A domain name owner may wish to assign a domain name to a third party. We can help with drafting and reviewing an assignment agreement.
    • Domain Name Enforcement – If a third party is using your trademark either in a domain name or within its website, Markery Law can counsel and assist with enforcement actions like a Complaint filed under the Uniform Domain Name Dispute Resolution Policy (UDRP) or equivalent.
